According to regulations, the apartment building management board has legal personality, possesses its own seal, and exercises rights and responsibilities as stipulated by the Housing Law. The election or dismissal of management board members shall be conducted through the apartment building conference without the need to establish a joint-stock company or cooperative.

In addition, according to the Regulation on Management and Use of Apartment Buildings issued together with Circular 05/2024/TT-BXD, the operating term of the apartment building management board is 03 years. 2.2. What is the difference between a management board and a management company?

The management board is the organization representing residents and apartment owners, elected through the apartment building conference to manage common issues such as the maintenance fund, operation supervision, and protection of residents' rights.

Meanwhile, the management unit or operation management unit is the entity directly responsible for the daily operation tasks of the building, such as security, cleaning, technical services, system maintenance, and resident care. This unit is usually hired by the management board or the investor and operates under an apartment building operation management contract.

2. Is it mandatory to establish a condominium management board?

According to the regulations on condominium management boards 2026, not all condominiums are required to establish a management board. The establishment of a management board will depend on the number of apartments and the ownership model of the building according to the regulations of the Housing Law 2023 and Circular 05/2024/TT-BXD.

For apartment buildings with fewer than 20 units, owners can decide for themselves whether or not to establish a management board. In cases where the apartment building has only one owner, the management board operates under a self-management model, without legal personality and no seal. 3. Rights of the apartment building management board 2026

3.1. For apartment buildings with multiple owners

According to the Regulation on Apartment Management Board 2026, the management board in apartment buildings with multiple owners will be granted extensive powers to represent residents in managing the building's common activities. These powers primarily relate to managing the maintenance fund, supervising the investor, and coordinating apartment building operations in accordance with legal regulations.

Specifically, the apartment building management board has the following rights:

Request the investor to fully hand over the maintenance fund after the management board is legally established and has submitted a written request for handover.

Request competent authorities to enforce the handover of the maintenance fund if the investor fails to comply with regulations.

Management and use of the common property maintenance fund of the apartment building in accordance with legal regulations and resolutions of the Apartment Building Conference.

Propose the Apartment Building Conference to approve the service price for managing and operating the apartment building.

Entitled to remuneration for responsibility and other expenses as decided by the Apartment Building Conference.

Request the competent authority to recognize the apartment building management board in accordance with regulations.

Request the investor to hand over all apartment building records; and have the right to request competent authorities to enforce the handover of records if the investor delays implementation.

Perform other tasks assigned by the Apartment Owners' Meeting, provided they do not violate current legal regulations.

3.2. For apartments that are public property

According to the regulations on apartment management boards 2026 , for apartments that are public property, the powers of the management board will be more limited compared to apartments with multiple owners. The management board in this case mainly exercises rights related to representative activities and tasks assigned by the Apartment Owners' Meeting.

Specifically, the management board of apartment buildings that are public property are entitled to exercise rights such as receiving remuneration for responsibility and other expenses as decided by the Apartment Building Conference; at the same time, they perform other tasks assigned by the Apartment Building Conference but not contrary to legal regulations.

For apartment buildings with an owner other than the case of public property, the management board is entitled to an additional right to request competent authorities to recognize the apartment building management board according to regulations. 4. Responsibilities of the apartment building management board 2026

4.1. For apartment buildings with multiple owners

According to the Apartment Building Management Board Regulations 2026, the management board in apartment buildings with multiple owners not only has the right to represent residents but also must perform many responsibilities related to operational management, maintenance funds, and maintaining order in the building. These responsibilities aim to ensure the apartment building operates transparently, safely, and in accordance with legal regulations.

Specifically, the apartment building management board has the following main responsibilities:

Register the seal, operating account, and maintenance fund management account of the apartment building.

Receive and manage apartment building records from the investor and provide them to the operational management unit when necessary.

Manage and use the maintenance fund in accordance with the financial regulations approved by the Apartment Owners' Conference; and publicly report on the collection and expenditure of the maintenance fund.

Sign contracts with the management and operation unit or the maintenance unit for common areas of the apartment building as decided by the Apartment Owners' Conference.

Supervise the operation of management, operation, and maintenance of the building's common areas.

Remind residents to comply with the regulations and rules for managing and using the apartment building; receive and synthesize opinions and recommendations from residents for coordinated handling.

Coordinate with local authorities in ensuring security and order, and building civilized living standards in the apartment building.

Comply with the operating regulations and shall not arbitrarily dismiss, remove, or add members to the management board in violation of regulations.

Be responsible before the law and residents if exercising powers and responsibilities incorrectly.

Comply with the handling decisions of competent state agencies and perform other tasks assigned by the Apartment Building Conference in accordance with the law.

4.2. For apartments belonging to public property

According to the apartment building management board regulations 2026, for apartment buildings that are public property, the responsibilities of the management board will primarily focus on maintaining management order, coordinating with residents, and ensuring compliance with legal regulations during the operation of the apartment building.

Specifically, the management board of apartment buildings that are public property has the following responsibilities:

Urging and reminding residents to comply with the internal rules and regulations for the management and use of the apartment building.

Collecting and synthesizing residents' opinions and recommendations to coordinate with competent authorities for consideration and resolution.

Coordinate with local authorities and the neighborhood group in maintaining security and order, building a civilized lifestyle in the apartment building.

Comply with the operational regulations and financial regulations approved by the Apartment Building Conference.

Be responsible to the law and residents if performing duties or exercising powers incorrectly.

Comply with the decisions of competent state agencies.

Perform other tasks assigned by the Apartment Building Conference and other responsibilities as stipulated by current law.
